INTERNATIONAL FINANCIAL CENTERS AND DISPUTE RESOLUTION MECHANISMS: INTERNATIONAL EXPERIENCE FOR VIETNAM

The development of an International Financial Center in Vietnam (VIFC) requires not only investment-attraction policies and modern financial infrastructure, but also an effective dispute resolution mechanism to ensure confidence among investors and facilitate cross-border transactions.

On the afternoon of June 18, 2026, Dr. Lawyer Nguyen Trung Nam – Founding Lawyer of EPLegal, and Mr. Phan Trong Dat – Partner of EPLegal, attended the Seminar on the International Financial Center in Vietnam organized by Hanoi Law University to discuss legal and practical issues relating to the establishment and operation of the VIFC.

In his latest presentation at the Seminar, Dr. Lawyer Nguyen Trung Nam analyzes the experience of developing dispute resolution mechanisms at leading international financial centers such as Singapore, London, and Dubai. The paper highlights the role of international commercial arbitration, specialized commercial courts, and supporting institutions in building investor confidence and ensuring legal certainty for cross-border financial transactions.

In particular, the paper focuses on analyzing the new features of the International Financial Center Arbitration Centre under the VIFC (VIFCA), including the mechanism for selecting the applicable law, the ability to limit court intervention in arbitral awards, support from specialized courts, and the orientation toward attracting highly qualified international arbitrators and experts.

Drawing from international experience, the paper provides important recommendations for improving the legal infrastructure of the VIFC, thereby enhancing its competitiveness and strengthening the confidence of the international investment community in Vietnam.
